This Privacy Policy (the “Policy”) describes how Dex Cognitive Analytics Inc. (“Dex”, “we”, “us”, or “our”), a corporation headquartered in Vancouver, British Columbia, Canada, collects, uses, discloses, and protects personal information in connection with the Ask for Dex platform and related services (collectively, the “Services”).

This Policy applies to all visitors, Applicants, Employers, and other users of the Services. By accessing or using the Services, you acknowledge that you have read and understood this Policy.

If there is any conflict between this Policy and our Terms of Service with respect to the collection, use, or disclosure of personal information, this Policy controls.

1. Scope

1.1 This Policy applies to personal information collected through the Ask for Dex platform.

1.2 The Ask for Dex platform is currently focused on serving users in the Canadian market.

1.3 This Policy is designed to comply with applicable Canadian federal and provincial privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and relevant provincial statutes.

2. Categories of Personal Information We Collect

Depending on how you interact with the Services, we may collect or process the following categories of personal information:

2.1 Identity and Contact Information Name, email address, telephone number, billing address, and other contact details you provide.

2.2 Account and Authentication Information Account identifiers, authentication tokens, session data, and related security information. The Services use passwordless authentication; we do not collect or store traditional passwords or security questions for ordinary Applicant or Employer accounts.

2.3 Professional and Assessment-Related Information Certification selections, work domains, assessment attempts, assessment responses and results, scores, attempt timestamps, entitlement records, retake or recertification status, and related professional data generated through use of the Services.

2.4 Credential and Public Verification Information Issued credentials, credential status, issue and expiry dates, public verification records, and associated metadata.

2.5 Employer and Organizational Information Organization name, domain, industry, size, team member names and roles, credit allocations and usage, invitation records, candidate names and email addresses supplied by Employers, invitation lifecycle status, and related organizational data.

2.6 Profile and Media Information Profile photographs and other account media you choose to upload.

2.7 Transaction and Commercial Information Purchase history, order details, payment confirmation data, plan selections, and related commercial records. Payment card data is processed exclusively by Shopify and its payment partners; Dex does not store full payment card numbers.

2.8 Device, Usage, and Technical Information IP address, browser type, device identifiers, operating system, referring URLs, pages viewed, interaction events, timestamps, and similar technical data.

2.9 Communications and Support Information Information you include in support requests, correspondence with us, and diagnostic data assembled to resolve your inquiry (which may include account, entitlement, assessment, credential, or invitation details necessary to provide support).

2.10 Analytics and Telemetry Information First-party analytics and event data, including credential-view events (Proof Activity), page interaction data, and related usage metrics generated by our own systems.

3. Sources of Personal Information

We collect personal information from the following sources:

  • Directly from you when you create an account, complete forms, upload materials, make a purchase, submit support requests, or otherwise interact with the Services.
  • Automatically through your use of the Services, including via cookies, session technologies, and server logs.
  • From service providers and processors acting on our behalf (including Shopify, Postmark, hosting providers, and analytics infrastructure).
  • From Employers when they supply candidate invitation data.
  • From publicly available sources or third parties where permitted by law.

4. How We Use Personal Information

We use personal information for the following purposes:

4.1 To provide, operate, maintain, and improve the Services, including account creation, authentication, assessment delivery, credential issuance, and public verification.

4.2 To process transactions, manage entitlements, credits, and invitations, and fulfill contractual obligations.

4.3 To communicate with you regarding your account, purchases, assessments, credentials, support requests, and important service notices.

4.4 To detect, prevent, investigate, and respond to fraud, security incidents, abuse, or violations of our terms.

4.5 To perform first-party analytics, measure usage, improve product performance, and understand how the Services are used.

4.6 To comply with legal obligations, respond to lawful requests from authorities, enforce our agreements, and protect our rights and the rights of others.

4.7 To send service-related and, where permitted, marketing communications. You may opt out of marketing communications at any time.

5. Cookies and Similar Technologies

5.1 We use strictly necessary cookies and similar technologies required for authentication, security, and core functionality. Applicant authentication cookies are persistent and are not limited to browser-session lifetime.

5.2 We also use first-party analytics technologies to understand usage patterns and improve the Services.

5.3 We do not currently operate third-party advertising cookies or cross-site tracking pixels on the core Applicant and Employer portals. Any analytics or marketing technologies operating on the Shopify storefront are governed by Shopify’s policies and configurations.

6. How We Disclose Personal Information

We may disclose personal information in the following circumstances:

6.1 Service Providers and Processors To vendors that perform services on our behalf, including Shopify (commerce and payments), Postmark (transactional email), hosting and infrastructure providers, security and monitoring tools, and other processors necessary to operate the Services. These parties are contractually restricted to using personal information only to provide services to us.

6.2 Employers and Candidates When an Employer invites a candidate, limited invitation-related information is processed to deliver and manage the invitation. Credential verification information may be made publicly available through our verification surfaces when a credential is valid.

6.3 Legal and Safety Reasons When required by law, legal process, or governmental request, or when necessary to protect the rights, property, or safety of Dex, our users, or the public.

6.4 Business Transfers In connection with a merger, acquisition, corporate reorganization, or sale of assets, subject to appropriate confidentiality and continuity protections.

6.5 With Your Direction or Consent When you instruct us to disclose information or otherwise provide consent.

We do not sell personal information.

7. International Transfers

Personal information may be processed in Canada and in other jurisdictions where our service providers operate. Where personal information is transferred outside Canada, we take appropriate contractual and organizational measures to protect it in accordance with applicable Canadian privacy law.

8. Retention

We retain personal information only for as long as necessary to fulfill the purposes described in this Policy, to meet legal, accounting, or reporting requirements, to resolve disputes, and to enforce our agreements. Credential and assessment integrity records may be retained for longer periods where required to maintain the integrity of the certification system.

9. Security

We implement reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, or alteration. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Your Rights

Subject to applicable Canadian law, you may have the right to:

  • Request access to personal information we hold about you;
  • Request correction of inaccurate personal information;
  • Request deletion of personal information, subject to legal and integrity exceptions (including records required to maintain credential authenticity);
  • Withdraw consent where processing is based on consent;
  • Opt out of marketing communications.

11. Children’s Privacy

The Services are not directed to individuals under the age of majority. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can take appropriate action.

12. Third-Party Services and Links

The Services may contain links to third-party websites or services. This Policy does not apply to those third parties. We encourage you to review their privacy policies.

13. Changes to This Policy

We may update this Policy from time to time. The revised version will be posted on the Services with an updated “Last Updated” date. Material changes will be communicated as required by law. Continued use of the Services after the effective date constitutes acceptance of the revised Policy.
